Terms and Conditions of Sale
These Terms and Conditions of Sale (hereinafter, "Terms and Conditions") apply to your purchases on www.hihonor.com/unitedkingdom and the contract you enter into with Huawei Technologies (UK) Co., Ltd., (hereinafter, "we", “our” or "Huawei"), a company incorporated in England and Wales having its registered office at 300 South Oak Way, Green Park, Reading, Berkshire, RG2 6UF and whose registered number is 4295981.
Please read the Terms and Conditions carefully so that you are aware of your rights and obligations. You can save or print these Terms and Conditions for your future reference. Huawei shall also save the text of the entire contract and make it available to you upon your request.
These Terms apply to all offers, contracts, and deliveries by Huawei on the website www.hihonor.com/unitedkingdom and all relevant subdomains ("Huawei Online Store") unless otherwise agreed.
2. Prices and Paymentn
2.1 Huawei's sales prices are listed in the Huawei Online Store and include all duties, fees, and other charges applied upon sales by Huawei, including VAT (if applicable).
2.2 All prices and information in the Huawei Online Store are intended to be accurate and complete; however, in certain situations pricing and other errors may occur. You shall have no right to rely upon a price that is obviously or materially lower than the prevailing retail price for that product or service. In the event that Huawei's published price for a product or service is obviously or materially lower than the prevailing retail price due to Huawei's pricing error, we have no obligation to sell at that price and shall be entitled to cancel the contract with you before shipment and delivery. Furthermore, if the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
2.3 Unless otherwise stipulated in the Huawei Online Store and in the order process, Huawei's delivery and administration charges are included in the final price payable for the products. Any charges or fees that will be added to the product price will be visible to you during the order process and before you place the order. For more information, refer to Huawei's Delivery Policy .
2.4 Payment shall be made by any payment methods offered in the Huawei Online Store. Any refunds to you will be made to the same card or through the same payment method you used when making the original payment.
3. The Contract
3.1Contracts will only be entered into through the Huawei Online Store and following your acceptance of these Terms and Conditions.
3.2 By clicking the purchase button you are placing a binding order for the products and services in your shopping basket (the “Offer”). Shortly after we have received your order, we will email you an order confirmation. The order confirmation email does not signify Huawei's acceptance of your order as it simply confirms that we have received your order. Once we have processed your order and prepared it for shipping, we will send you an email stating that we have accepted your order, which will include the shipment details (the "Acceptance"). Before you receive Huawei's Acceptance, you have the right to cancel your Offer. Circumstances where your order might not receive Acceptance by Huawei include situations where: the product is out of stock; we are unable authorize your payment; due to unexpected limits on our resources which we could not reasonably plan for; or we have identified an error in the price or description of the product.
3.3Your contract with Huawei will solely be concluded in the English language.
3.4You need to be at least 18 years old to place orders in the Huawei Online Store.
3.5Title: You do not own a product which is goods until we have received full payment.
3.6 Each order must be paid for in advance of delivery by any payment methods offered in the Huawei Online Store. Products will only be shipped after Huawei's verification of your payment.
3.7 You are solely liable for payment of any fees charged by your bank, card issuing company or other provider of your selected payment option.
4.1 Your order and contract will be processed and performed when we have received your payment. We are not obliged to ship any products before we have received the full payment for the product.
4.2 We may refuse single orders for multiple products with different delivery periods or different delivery addresses.
4.3 If it is not possible for Huawei to ship the products within the delivery period mentioned in the Huawei Online Store or order confirmation, we will inform you thereof and allow you to terminate the contract, in which case any payment made to Huawei will be reimbursed. Your other rights and remedies under consumer law remain unaffected.
4.4 Location of Delivery: We do not deliver to addresses outside the UK.

5. Right to Cancel (Consumer Contracts Regulations 2013)
5.1 As a consumer, you have the right to cancel your contract within fourteen (14) days without giving any reason. The cancellation period is fourteen (14) days from:
1. in the case of a sale contract for a good: the date on which you, or a third party named by you who is not the carrier, have or has taken possession of the goods;
2. in the case of a contract for multiple goods which you have ordered as part of a single order and are delivered separately: the date on which you, or a third party named by you who is not the carrier, have or has taken possession of the last goods;
3. in the case of a contract for the supply of a good in multiple parts or pieces: the date on which you, or a third party named by you who is not the carrier, have or has taken possession of the last partial shipment or part;
4. in the case of a contract for the regular delivery of goods for a fixed period: the date on which you, or a third party named by you who is not the carrier, have or has taken possession of the goods for the first time;
5. in the case of a service contract or a contract for the supply of digital content that is not delivered on a physical data medium: the date of conclusion of the contract.

In order to exercise your right to cancel in time, it is sufficient that you send the notice of your decision to cancel before the expiration of the cancellation period.
Where the last day of a period expressed otherwise than in hours is a public holiday, Sunday or Saturday, the period shall end with the expiry of the last hour of the following working day.
You may also use the Model Cancellation Form (please download here), if you prefer, but its use is not mandatory.
5.2 Consequences of Cancellation
In the event that you cancel your contract, we will immediately refund all payments we have received from you, including delivery charges (except for additional costs arising from your selection of a different delivery method that is more expensive than the standard delivery offered by Huawei) no later than fourteen (14) days after the date on which the notification of your cancellation of your contract has been received by Huawei. Refunds shall be issued to you using the same means as your original payment, unless otherwise agreed upon between you and Huawei. In no event will we charge you any fees for receiving this refund.
We may refuse to refund you until we have received the products back or until you have provided proof that you have returned the products, whichever is earlier.
You must return the products to Huawei immediately, and in any event not later than fourteen (14) days from the date on which you notify Huawei of your cancellation of your contract. You will only have to bear the direct costs of returning the goods, if any, in accordance with our Return Policy. The deadline is considered to have been met if you send the products before the expiration of the period of fourteen (14) days.
If you cannot return the products to Huawei in whole or in part, or there is a reduction in value of the goods due to your handling them in a way which would not be permitted in a shop, your refund (excluding delivery costs) may be reduced or you must compensate Huawei for the reduction in value. You are responsible for any loss of value of the goods if this loss of value is due to excessive handling beyond what is necessary to establish the nature, characteristics, and functionality of the goods.
If you have requested that the services should commence during the cancellation period, you must pay us a reasonable amount corresponding to the proportion of the services already provided at the time you notify Huawei of your intent to exercise your right to cancel in respect of this contract in comparison with the total volume of services provided for in the contract.
5.3 Exclusion of the Right to Cancel
You do not have the right to cancel the following contracts:
Contracts for the supply of goods which are .
Contracts for the supply of goods if, due to their nature, they were inseparably mixed with other goods after the delivery.
Contracts for the supply of goods, which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
Contract for the supply of sealed computer software, which was unsealed after delivery.
5.4 Expiry of the Right to Cancel
Your right to cancel is subject to expiry in the following circumstances:
In the case of services, after they have been fully rendered, provided that you have previously expressly agreed and confirmed that it will lose its right to cancel once the services have been fully rendered. If the services have not been fully rendered and you have agreed that they will be rendered within fourteen (14) days of the conclusion of the services contract, then you will receive an amount proportional to the services already rendered until the date on which it has notified us of its intent to cancel from the service contract.
In the case of the supply of digital content which is not supplied on a tangible medium, if the performance, download or streaming has begun with your prior express consent, you acknowledge that you hereby lose your right to cancel.

6. Bundles and Gifts
From time to time, Huawei may offer you bundled products or provide you with a gift if you purchase in our Huawei Online Store. These bundles and gift promotions are only provided under the condition that you keep the products. To receive your full refund, we recommend that you return the bundled products and gifts in their entirety. If you are not be able to do so, you may have to pay us a proportionate compensation or we may reduce your refund.
7. Huawei's Warranty Policy
Huawei voluntarily offers a limited warranty in respect of certain Huawei branded products and accessories. The applicable warranty terms and conditions can be reviewed at Warranty Policy and are also contained in your Huawei packaging box.
The Huawei Warranty Policy is separate and in addition to the legal rights of consumers under applicable local country laws governing the sale of consumer goods and does not affect your legal rights in relation to faulty or misdescribed products.
8. Consumer Law Rights
If you are a consumer we are under a legal duty to supply products that are in conformity with this contract. If you wish to exercise your legal rights to reject products you must return them to us. We will pay the costs of postage or collection. For details on how to return products purchased in the Huawei Online Store, please see our Return Policy. Nothing in these terms will affect your legal rights.
9. Force Majeure
Huawei is not responsible for delays outside its control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
10.Complaints and Dispute Resolutions
10.1 If you have a complaint about the handling of the contract or the provision of Huawei's services in relation to your purchase of the products, you may contact Huawei through https://www.hihonor.com/unitedkingdom/support/.
10.2 You (being a consumer) may also report and submit a complaint to the local country Online Dispute Resolution bodies authorized on the ODR platform of the European Commission at http://ec.europa.eu/odr. Huawei is not obliged to participate in and does not intend to participate in a dispute resolution procedure before an Alternative Dispute Resolution entity (ADR) or in an EU Online Dispute Resolution (ODR).
10.3 You are always welcome to contact the Huawei customer service center by hotline/live chat/email if you need help when you return/replace your products.
11.1 The products are manufactured according to specifications and intended for use in the countries of the European Economic Area (EEA), UK and Switzerland.
11.2 The contract and all products are subject to applicable export control laws, including the export control laws of the USA. You may not export any product purchased from Huawei to any country outside the EEA, UK or Switzerland if prohibited by export control laws. If you plan to export any product purchased from Huawei to another country, you must obtain the required export licenses (or other government approvals) prior to doing so.

Privacy Statement about Hihonor E-commerce Platform
The HiHonor E-commerce Platform (hereinafter, referred to as "the Platform") is a network platform consisting of APP, WAP website and WEB website that you can visit to purchase Honor products provided by Huawei Technologies (UK) Co. Ltd. as the data controller, a company duly incorporated and existing under the laws of England and Wales, with its registered office located at 300 South Oak Way, Green Park, Reading, Berkshire, RG2 6AD and whose registered number is 4295981 (hereinafter referred to as “Huawei”, "we", "us" or "our").
We understand the importance of your privacy. Please take the time to read this Privacy Notice carefully to understand how we will use your personal data. The Platform is not intended for use by users under the age of 18. If you are aged under 18, you need your guardian to agree to your use of the Platform and agree to relevant terms thereof.
1.What data do we collect about you?
We will collect and use the following personal data only for the purposes stated in this Statement. Personal data means any information that enables us to identify you as a user.
-Device information: device identifiers, browser information, system settings information, device hardware information and basic application information.
-Network information: IP address, network type, network operator information, and network connection status;
-Account information: Email address and/or phone number; and if you log in using your Huawei ID, personal data disclosed by Huawei subsidiary, Aspiegel Limited, about your HUAWEI ID, including your date of birth, profile picture and nickname and UID.
-Order information: information of the buyer and recipient (if different), including name, phone number, post code, shipping address, email address, billing address and the order number generated to process your order.
-Payment information: if you choose to pay by credit card or debit card, card holder’s name, card number, expire date, card verification value, SMS verification code; if you choose Ideal, please provide information according to Ideal’s guidance. To process your payment, we will generate a payment number.
-Delivery information: shipment number generated by us and tracking number obtained from the delivery company.
-Information for return: post code for drop-off or pick-up, contact name, pick-up address, email address and phone number for contact. We will generate a return number for you.
-Customer service information: the name, phone number and email address you entered, and the email content, recordings, chat records.
-Product review: including any of your comments on our products, enquiries, ratings and likes.
-Service usage information: browsing and clicking records.
2.How do we use your data?
(1)To provide you with requested services and fulfil our contractual obligations to you, we process the following data for the associated purposes. Unless otherwise stated in this Statement, you will no longer be able to enjoy the relevant service(s) if you refuse the collection and processing of your personal data for these services:
Log-in: If you choose to log in with your HUAWEI ID as a Member of the Platform, we will process the information contained in the HUAWEI ID account to provide you access to the services you are logged in to. . If you do not want to log in with your HUAWEI ID, you can continue to use the website and purchase products using the guest check-out.
Membership service: As a Member of the Platform, you can maintain frequently used recipient information, manage your reviews, check internal messages and check rights and interests related to your membership.
Notify Me: If a product is not available, you can click “notify me” and leave us your email address so that we can notify you when the product is available for purchase.
Online purchase: Your order information and payment information is needed to process payment, issue invoices, fulfill purchase orders, deliver purchases to the designated address, and to update you of your order progress. If you start the return process, we need to collect information to process your return.
Verification: To make sure your order has been fulfilled, to verify and inspect the devices you send back to us for return, and confirm warranty status, we process your device identifier, delivery information and order number.
(2)We use your personal data based on our legitimate interests as follows:
Handling customer enquiry: If you contact us through our customer service to make an enquiry, such as on price, fulfilment of order, promotions, rights and interests, your order number is usually needed to locate the concerned order. We will collect the customer service information so as to inform you about the result or progress. Further information may be required dependent on the nature of your enquiries. We will not be able to respond to your customer requests if you object to the processing of this information by us.
Risk-control: To ensure the security of payment, prevent theft, fraud, non-fraud, financial security hazards, and malicious network attacks, your device identifier, IP, HUAWEI ID account information, order information, and payment information, will be collected and processed. If you object to the processing of such data, your payment will be suspended and you will be unable to proceed with the purchase.
Handling the disputed payment: We will transfer your UID, order information, payment number and delivery information to the payment service provider to facilitate the issuer banks in resolving disputed payments.
Accounting: we will process your order information and payment information for automatic tax calculation, daily accounting and daily reconciliation.
Business analysis and improvement: we process your order information, payment information and device information to measure and improve our services, to forecast stock management, for accounting analysis, and to settle invoices from our suppliers.
Product reviews: You can leave and share your product reviews on our Platform. Log-in is required for this. Your product review and profile picture will be published on our Platform.
Frequently asked questions on the product page: as a Member of the Platform you can ask questions through the product page. The questions raised and our answers will be posted online to guide other users.
(3)We process your personal data based on your consent:
Electronic communications: with your consent, we will use your email address or device information to send you marketing communications by email or by third-party tools.
If we have obtained your email address and/or phone number in connection with the sale of goods or services, we may use that email address for direct advertising of our own similar goods or services.
You can object to the use of your personal data for marketing purposes at any time. For further details how, please see Section 5: Your rights and choices. You have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before your withdrawal.
(4)Additionally we will process your personal data as necessary to comply with legal obligations, including tax and accounting requirements, and to establish or defend our legal rights and/or to prevent, detect and pursue potential fraud attempts or cyber-attacks.
3.How long do we store your data?
We retain your personal data for no longer than is necessary for the purposes defined in this Statement. In particular:
-We retain order information and payment information for 7 years from the date the transaction for the purposes of after-sales services, and legal compliance to tax, and financial-related laws or regulations. If you deactivate an account or voluntarily delete an order during the data retention period, we reserve the right to retain these transaction records in our archives until the end of the above retention period.
-We retain customer service information for 3 years from the date of collection.
-We retain service usage information for 2 years from the date of collection.
-We retain your HUAWEI ID account information, your frequently used information of recipient and your rights and interests as a member until you deregister your HUAWEI ID, until the service is suspended or your account is terminated for any other reasons.
-Product reviews that you post on our product pages are presented with your nickname and profile photo and remain posted for as long as such function is still accessible.
-Enquiries you submit via the product page will be posted online under a pseudonym in order to guide other users and will be retained for as long as such feature is still accessible.
After the retention period expires, we will erase or anonymize your personal data, unless otherwise required by laws and regulations.
In relation to each of the retention periods above you can specifically request for earlier deletion by exercising your rights of objection and erasure under Section 5: Your rights and choices. Requests will be handled in accordance with applicable legal requirements.
4.Do we share your data?
(1)Disclosure of your personal data outside of the EU/EEA:
Disclosure with our affiliates outside of the EEA: To have our affiliates conduct business verification , warranty confirmation and accounting , order number, delivery tracking number and device identifier will be transferred to China.
We use Google Firebase for data analysis and electronic communications. Information about your device and service usage will be processed anonymously in the United States by Google.
We comply with applicable legal requirements for providing adequate safeguards by incorporating the EU Commission standard data protection model clauses to such transfer. You can visit "Privacy Enquiries" to obtain a copy of the data transfer agreement.
(2)Disclosure of your personal data within the EU/EEA:
-Disclosure with our service providers
We use intragroup and third party service providers to provide services, including warehousing services, notification services, process payment, electronic communications services, promotion administrators and customer service providers. They will have access to your personal data only insofar as required to fulfil their contractual obligations to us. Our services providers have been carefully selected and commissioned by us, are bound by contract and will not process your personal data for any other purposes.
When processing your payment, the payment information you submitted will be shared between the payment service provider and the issuer banks. We will store the payment number and 10 digits of your card number, otherwise Huawei will not store the payment information. To handle the disputed payment and in accordance with our contract with the payment service provider, we will disclose the order information, payment number and delivery information to such payment service provider to facilitate the payment institutions.
-Disclosure with other third parties
We share your personal data with logistic providers DHL to delivery or collect devices to/from you. DHL processes your personal data subject to their privacy notices.
(3) Disclosures related to legal requirements
We may share your data in response to a legal process or request from a competent authority based on an applicable law or in connection with legal proceeding or process.
Your data may also be disclosed as part of merger, acquisition, sale of assets (such as service agreements) or transition of service to a Huawei affiliate or other company.
5.What are your rights and choices?
You have the following rights and choices:
-Right of access:
You can request a confirmation as to whether or not personal data about you is processed and you can, where applicable, receive a copy of personal data we process about you.

You can access your order information, address information, subscription information on My Account/Account page. You can click the shopping cart icon to access your shopping cart.
(2) You can exercise your data subject rights through "Privacy Enquiries".
-Right of portability:
You can receive certain data that you have provided to us in a machine-readable format. If you need to obtain a digital copy of your personal data:

You can have your data erased under certain conditions.
