HIHONORRefresh campaign (“Campaign”) is organized by Huawei Technologies (Netherlands)B.V. (herein: “Organizer”). This Campaign will run from 5st July 2020,00:00a.m (UTC) till 31th Oct. 2020, 11:59p.m (UTC)(“Campaign Period”). Organizer reserves the right to shorten or extend theCampaign Period at its sole discretion without prior notice.
Eligibility for Participation
2.1In order to participate in this Campaign, participants (“Participant(s)”) must comply with the followingcriteria:
i.The campaign is open to allentrants who, at the date of entry, are aged 18 years or over; and
ii.Who are resident in the Netherlands.
2.2The Organiser’s employees,their immediate family members, and employees of co-operation partners who areor were involved in creating or implementing the competition, are excluded fromparticipation.
2.3Participation is onlypossible on one’s own behalf and joint submissions are not allowed.
2.4 Every participant who has successfully registered to receive the HiHonor newsletter in compliance with these conditions of participation during the campaign period will receive a voucher worth € 10 for orders on the Netherlands HiHonor website. The voucher can only be redeemed when purchasing amount is bigger than 50€.The voucher can be redeemed once from 08/01/2020 - 10/31/2020 and is automatically deducted from the invoice if the voucher code is entered when ordering. The participant receives the code after registering in their account.
3.1 The Participant agrees andprovides consent to the Organiser for the use of necessary Personal Data asprovided by the Participant for the purpose of participation in this Campaignin line with the Personal Data Protection laws and regulations, to the extentthat any personal data provided shall only be processed and be used by theOrganiser for lawful purposes directly related to the running of this Campaignincluding but not limited to the purposes of promotional events, advertising, marketingand any administrative matters to facilitate the management and organizing ofthis Campaign.
The Participant hereby agreesthat the Organiser and/or its agent(s) and its third party service providersmay contact them by telephone, email or such other method of communicationwhich is in connection with this Campaign.
3.3 In the event of any freegift, vouchers or prizes being awarded to the successful Participant and uponsubsequent findings it is later discovered that such Participant havingprovided false or mistaken identity or information, then the Organiser reservesthe right to revoke the Participant’s eligibility for the said free gift,vouchers or prizes.
3.4 By participating in theCampaign, Participants agree to be bound by these Terms and Conditions and thatthe Organiser’s decision shall be final and binding. No correspondence orappeals will be entertained. The Organiser reserves the right to the final andultimate interpretation of this Campaign.
3.5 In accepting any free gift,vouchers or prizes, the Participants agree to participate and cooperate asrequired in all editorial activities relating to the Campaign. The Participantsagree to grant the Organiser a perpetual and non-exclusive license to use suchfootage and photographs, voice, biographical information and/or statements, atany time or times, in all media types worldwide for advertising, trade,publicity and promotional purposes and the Participant will not be entitled toany fee for such use.
3.6 To the extent permitted bylaw,the Organiser assumes no responsibility for late entries due to any reasonsincluding, but not limited to, network transmission failure.
3.7 To the extent permitted bylaw, the Organiser shall not be responsible for any losses or damages directlyor indirectly incurred by any party including the Participant in connection orarising from any acts or omissions or in any way related to this Campaign.
3.8 The Participant agrees todischarge and release Organizer from any liabilities and claims (including frombreach of contract, tort, negligence or any other cause of actions at law orequity) arising out of or in any way connected to this Campaign or to theParticipant’s entry in the Campaign ,to the extent permitted by law.
3.9 The Participant furtheragrees to discharge and release any third party which is related to andconnected with this Campaign, to the extent permitted by law. includingFacebook, Instagram or any social media platforms from any further liabilitiesand claims (arising from and including breach of contract, tort, negligence orany other cause of actions whether at law or in equity) arising out of or inany way connected to this Campaign or to the Participant’s entry in theCampaign.
3.10 By entering into thisCampaign and any events therein, the Participant agrees to indemnify and holdthe Organiser and the Organizer’s Group of Companies, their officers, directors,shareholders, predecessors, successors in title, employees, agents andrepresentatives harmless from any claims, losses, damages, liability, claims orexpenses (including any legal fees), suffered or incurred by the Organiser dueto or in any way arising from this Campaign.
3.11 If Participants arediscovered to be using or have used improper means to participate in thisCampaign and any events therein, the Organiser reserves the right to cancel theCampaign without notice including without hesitation, the commencement of legalproceedings under the full extent of the applicable laws.
3.12 Under normalcircumstances, orders will be delivered within 3 working days. However,expected delivery dates are indicative and the Organiser reserves the right toextend expected delivery dates.
3.14 This Campaign and theTerms and Conditions herein shall be governed by the laws of the Netherlands.
4.1 The Organiser’s decisionregarding all promotional matters will be final, and no correspondence will beentered into.
4.2 In the event ofcircumstances outside the reasonable control of the Organiser, or otherwisewhere fraud, abuse, and/or an error (human or technical) affects or couldaffect the proper operation of this promotion or the awarding of prizes, theOrganiser reserves the right to cancel or amend these Terms and Conditions atany stage and will use its reasonable endeavors to minimize the effect toparticipants in order to avoid undue disappointment.
4.3 If any provision of theseConditions of Participation is held invalid by any law, rule, order orregulation of any government, or by the final determination of any court ofcompetent jurisdiction, such invalidity shall not affect the enforceability ofany other provisions not held to be valid.
4.4 All legal relationshipsarising from or in connection with these Terms and Conditions and thecompetition are subject to Dutch Law.
